If your income is enough to make mortgage payments under the plan, any foreclosure proceedings will stop, and you may keep your home. If not, you could still lose the home to foreclosure.

Litigation

If your lender has begun foreclosure proceedings, talk to a lawyer at our firm about your circumstances. Thousands of home mortgages have been found legally defective for the purpose of foreclosure. In Massachusetts, a case called the Ibanez case brought this to light. For example, if the lender does not have proof of the chain of title, then they cannot prove they hold a valid mortgage. Without this they cannot foreclose on the home.

Other Options

Many circumstances may motivate a lender to modify your existing loan. If so, you may be able to keep the home with a lower interest rate, and lower payments. A short sale or deed in lieu of foreclosure may be alternatives to foreclosure. "Walking away" from a home however concedes foreclosure. You may be on the hook for what you owe under the mortgage.
